Restoring Affirmative Action for the Public Sector

Would have restored the ability for the public sector to utilize affirmative action in public contracting, public employment and public education in order to directly address racial and gender equity in state hiring and college admissions. Assembly Constitutional Amendment (ACA) 5, which required voter approval, became Proposition 16 on the November 2020 General Election ballot and was rejected by voters, would have repealed a 1996 voter approved initiative (Proposition 209) which banned the use of affirmative action in the public sector.
